The Occupational Health and Safety Act 2004 in Victoria imposes duties on employers, the self-employed, employees, manufacturers, suppliers and others.
These duties include the requirement for employers to ensure that risks to health and safety are eliminated so far as is reasonably practicable, and if it is not reasonably practicable to eliminate risks, then reduce those risks so far as is reasonably practicable using the hierarchy of control.

For employers, these duties are extended to employees of contractors and other persons.
Additionally, section 22 (2) (b) of the Act requires employers to “employ or engage persons who are suitably qualified in relation to occupational health and safety to provide advice to the employer concerning the health and safety of employees of the employer.”
